Introduction
Search ranking is one of the most influential everyday outputs of artificial intelligence. When a search engine decides which links appear first, it affects what information people see, which businesses gain visibility, and which viewpoints receive attention. The European Union’s Digital Services Act (DSA) responds to this reality by treating major ranking and recommendation systems as infrastructure that deserves greater transparency and accountability. Rather than forcing companies to reveal their source code, the DSA requires them to explain the main factors that shape rankings, give users more control over recommendations, and subject the largest search services to additional oversight and risk management obligations. Why regulators care about ranked visibility
Search rankings are not merely technical outputs. They determine which sources are easiest to find and which remain largely unseen. Because users disproportionately click highly ranked results, ranking systems can influence public knowledge, commercial success, and democratic debate even when they are not intentionally promoting any particular viewpoint.
European policymakers increasingly view these systems as powerful gatekeepers of attention. The DSA was designed around the idea that online platforms and search engines shape access to information at a societal scale and therefore require stronger accountability mechanisms. For the largest services, the law imposes special obligations because their reach means that flaws in ranking systems can have broad effects on public discourse, consumer choice, and fundamental rights. The Act distinguishes especially large services known as Very Large Online Platforms (VLOPs) and Very Large Online Search Engines (VLOSEs). These are services reaching at least 45 million monthly users in the EU, a threshold intended to identify systems whose ranking decisions can have significant societal consequences. What ranking transparency is meant to reveal
The DSA does not require search engines to publish their algorithms in full. Instead, it focuses on making ranking systems understandable enough for users, regulators, and researchers to evaluate their effects.
A central requirement is that services using recommender or ranking systems must explain the main parameters that influence what users see. These explanations must be written in clear language rather than technical jargon. Users should be able to understand the major signals that shape recommendations or rankings and learn what options exist to influence those outcomes. In practice, this means companies may need to explain factors such as:
- Previous searches or viewing history.
- User interactions such as clicks, likes, or watch time.
- Geographic location.
- Language preferences.
- Freshness or popularity signals.
- User-selected settings and controls. [Freshfields]freshfields.comdsa decoded 10 algorithmic transparency under the dsa 102mgg8DSA decoded # 10: Algorithmic transparency under the DSA6 Feb 2026 — Online platforms to disclose the main parameters used in…
The goal is not to reveal every mathematical detail. Instead, the law seeks to answer a practical question: “Why am I seeing this result rather than another one?” That represents a shift away from treating ranking systems as entirely opaque black boxes. User choice as a form of transparency
The DSA links transparency to user control. Simply describing a ranking system is considered insufficient if users cannot act on that information.
For many platforms, the Act requires that available recommendation options be presented clearly and that users be able to modify their preferred ranking settings. For the largest platforms and search services, at least one recommendation option must not rely on profiling based on personal data. This reflects a broader regulatory idea: meaningful transparency should help people choose how information is organised, not merely inform them after the fact. This approach moves beyond the older notion of algorithmic transparency as disclosure alone. The DSA increasingly treats user choice as part of accountability. Researchers have described this shift as a move from pure transparency towards “algorithmic choice”, where users gain some ability to influence the systems that shape their information environment. Why the largest search engines face stronger scrutiny
The DSA applies broadly, but the most demanding obligations fall on VLOPs and VLOSEs because of their scale. Regulators argue that a ranking error affecting a service used by tens of millions of people is fundamentally different from the same error occurring on a small platform. [Digital Strategy]digital-strategy.ec.europa.euDigital StrategyDSA: Very large online platforms and search enginesThe DSA classifies platforms or search engines that have more than 45…
Under the Act, these large services must assess and mitigate systemic risks connected to how their systems operate. Ranking and recommendation systems are part of those assessments because they can amplify harmful content, distort information flows, or contribute to other societal risks. Regulators can therefore examine not only what a ranking system does for individual users but also what effects it may have across society. The DSA also creates transparency-reporting obligations and enables access mechanisms for regulators and vetted researchers. The underlying idea is that public accountability requires more than company self-description; external scrutiny is needed to test whether ranking systems operate as claimed. Limits of explaining complex ranking systems
Although the DSA pushes for greater transparency, explaining modern ranking systems remains difficult.
First, search and recommendation systems often rely on thousands of signals and constantly evolving machine-learning models. Any public explanation must simplify reality. A statement such as “watch history influences recommendations” may be accurate while still leaving unanswered questions about how strongly it matters compared with other factors. Researchers frequently describe this as a challenge of meaningful transparency rather than mere disclosure. [dsa-observatory.eu+2Interface]dsa-observatory.euThe Regulation of Recommender Systems Under the DSA22 Nov 2024 — The DSA is the first supranational regulation that aims to address the c…
Second, there is a trade-off between openness and system integrity. If ranking formulas were disclosed in excessive detail, they could become easier to manipulate through spam, gaming, or strategic optimisation. The DSA therefore focuses on revealing principal parameters and user controls rather than demanding complete publication of ranking algorithms. [EU Digital Services Act+2Pinsent Masons]eu-digital-services-act.comEU Digital Services Act Article 27, the Digital Services Act (DSA)1Providers of online platforms that use recommender systems shall set out in their terms and conditions, in plain and intelligible languag…
Third, transparency alone does not guarantee understanding. A company may provide legally compliant explanations that remain difficult for ordinary users to interpret. Scholars and civil-society organisations have argued that the real challenge is ensuring that disclosures are useful enough to support informed choices and meaningful oversight. What the DSA changes in the wider AI debate
The significance of the DSA extends beyond search engines. It represents one of the first major attempts to govern AI-driven ranking systems through transparency, accountability, and user empowerment rather than through direct control of algorithm design.
Instead of asking regulators to decide how rankings should work, the Act requires companies to explain the main drivers of visibility, provide alternatives where possible, assess systemic risks, and submit to greater scrutiny when their services reach enormous audiences. In that sense, the DSA treats ranking systems as socially significant decision-making systems whose influence warrants public oversight. For understanding artificial intelligence, this is an important shift. Search ranking is often experienced as a simple list of results, yet the DSA reflects a growing recognition that these rankings are AI-mediated judgements about relevance and visibility. The law’s transparency requirements are an attempt to make those judgements more visible, more contestable, and more accountable to the people affected by them.
